The client had worked as a software developer and, after leaving the company, moved to another company in the same industry. The former employer filed a criminal complaint alleging trade secret leakage and violation of the Copyright Act.
This case involved a dispute between IT companies over alleged trade secret infringement and copyright infringement, with the key issue being the alleged unauthorized leakage and use of software source code. However, digital forensic examinations of the client??s electronic devices found no evidence that the client had leaked trade secrets, and the matters asserted by the complainant were also difficult to characterize legally as trade secrets.
As to the alleged copyright violation, Taelim also explained, through source code similarity analysis, that there was no substantial similarity.
A decision not to forward the case to prosecution was issued on all allegations.
