  • Criminal Litigation False Accusation Case Closed Without Referral to Prosecution After Defense Against Claim of False As

  •

The client called 112 and reported that the other party had assaulted the client at an entertainment establishment. Later, however, the other party claimed that no assault had actually occurred and raised an accusation of false complaint against the client, alleging that the client had made a false report for the purpose of having the other party criminally punished.

A false accusation offense is a serious crime that requires more than a simple misunderstanding or factual dispute. It must be established that the reporter intended to have the other party criminally punished and knowingly reported false facts.

The client, despite having reported being a victim, was at risk of becoming a criminal suspect and facing criminal punishment.

Taelim Law Firm determined that the key issue was not whether the assault itself could be clearly proven, but whether it had been affirmatively proven that the client’s report was contrary to objective truth and that the client was aware of its falsity.

Taelim’s defense team carefully organized the circumstances, including the fact that the client had been intoxicated at the time and therefore had difficulty specifying the exact time of the assault, the fact that the client protested to the other party immediately after recognizing the assault and that the dispute continued at the counter, and the medical certificate confirming bruising on the client’s face.

Taelim also considered witness statements that the witnesses had heard the dispute and had heard the client complain of assault, emphasizing that the client’s report could not be conclusively deemed entirely false.

Taelim did not merely assert that the case was not a false accusation. Instead, it built a legal defense structure showing that the elements required for false accusation, namely awareness of falsity and the purpose of causing criminal punishment, had not been proven.

The investigative authority accepted Taelim’s arguments.

It found that the mere fact that an assault or physical collision was not clearly shown in the transcript could not amount to affirmative proof that no assault occurred, and that, considering the medical certificate and witness statements, it was difficult to conclude that the client’s report was contrary to objective truth.

Ultimately, the client received a decision of no charge and no referral to prosecution due to insufficient evidence.

In false accusation cases, the fact that the original report is not ultimately proven with clarity does not automatically establish false accusation.

It must be strictly proven that the reported facts were contrary to objective truth and that the reporter knowingly made a false report. This case is an example of Taelim accurately identifying that exact point.

In a case that could have proceeded unfavorably against the client based solely on the transcript, Taelim comprehensively presented the medical certificate, on-site circumstances, and witness statements to directly prevent the establishment of a false accusation offense.

Even where a person who reported harm was placed in the position of a suspect for false accusation, Taelim’s meticulous factual analysis and accurate legal response enabled the client to avoid the risk of criminal punishment.
