  • Intellectual Property (IP) Copyright Infringement Mediation Secured: Unauthorized Character Use and SNS Posts Removed

  •

The client discovered that a character created by the client was being used without consent in SNS posts and the production of online merchandise.

The other party had posted images and videos containing the character and had even produced and sold products using it.

Because the character could be commercially exploited beyond mere posting, the case required prompt cessation measures and prevention of recurrence.

Taelim Law Firm did not stop at simply requesting deletion. It focused on preventing the same issue from recurring through measures to prohibit copyright infringement.

Taelim organized the circumstances of character use, the status of SNS posts, and the circumstances of merchandise production and sales, and structured a mediation proposal so that the other party could no longer reproduce, distribute, publicly transmit, or use the character for product production.

Taelim also established practical protective measures, including deletion of existing SNS posts, prohibition on producing additional products, and prohibition on sale, distribution, and display.

As a result of the mediation, the other party agreed to stop using the character in SNS posts, reproduction, distribution, public transmission, and merchandise production and sales.

The other party also agreed to delete existing SNS posts and not to produce or sell additional products in the future.

The mediation also included a clause requiring the other party to pay a penalty for each day of violation, thereby securing the effectiveness of recurrence prevention.

Character copyright infringement can quickly expand from SNS posts to merchandise production and online sales.

If not properly addressed at an early stage, the creator’s rights may continue to be infringed.

This case is an example of Taelim obtaining mediation that included not only deletion, but also cessation of use, removal of posts, prohibition on additional production, and penalty provisions.

Through Taelim’s prompt and meticulous response, the client was able to protect the creative work and prevent the possibility of future infringement.
