The client had lent money to a debtor, but the debtor failed to repay it by the agreed deadline.

The client had obtained an enforceable original copy of a performance recommendation decision in the loan case. However, receiving a judgment or decision does not mean that the money is immediately recovered.

Unless the debtor voluntarily repays, actual recovery requires identifying claims that the debtor holds against a third party and promptly seizing and collecting those claims.

The court found Taelim’s application to be well-founded. As a result, the debtor’s claim against the third-party debtor was seized, and the third-party debtor could no longer pay the relevant amount to the debtor. The debtor also became unable to dispose of or directly receive the seized claim.

Furthermore, the client obtained the authority to directly collect the seized claim.

The client’s rights are realized only when the process continues through enforcement procedures that can actually recover money.
