  • Criminal Litigation Sex Crimes Suspended Sentence Secured in Prostitution Brokerage Case Despite Risk of Imprisonment

  •

The client was indicted on charges of jointly operating a prostitution establishment, brokering prostitution, and posting advertisements for the establishment on an internet site. The investigative authority viewed the client as having been directly involved in the operation of the establishment, posting of advertisements, management of employees, and distribution of profits, and applied charges under the Act on the Punishment of Acts of Arranging Sexual Traffic by specifying the actual amount of profit and period of operation.

In particular, the possibility of imprisonment was very high because the establishment had operated for a long period, the advertising conduct was also at issue, and the amount of profit was not insignificant.

From the early stage of the case, Taelim Law Firm adopted a strategy focused on sentencing defense rather than unreasonable denial. Taelim’s defense team actively organized the fact that the client acknowledged the offense and was cooperating faithfully throughout the investigation and trial.

Taelim also systematically presented to the court the absence of prior convictions for similar serious crimes, the maintenance of social ties, and circumstances that could reduce the possibility of reoffending.

In particular, Taelim did not merely ask for leniency, but specifically analyzed the circumstances of the offense, the client’s actual role, the profit structure, and the client’s conduct after the offense, and persuasively argued that rehabilitation within society, rather than imprisonment, was sufficiently possible.

In addition, Taelim responded strategically by considering the possibility of additional dispositions, including confiscatory collection, fines, and community service, so as to minimize the overall sentencing burden.

The court accepted Taelim’s arguments. Although the court recognized the significant social harm of prostitution brokerage and acknowledged the operation of the establishment and advertising activities, it considered the fact that the client admitted and reflected on the offense and had no serious criminal record.

As a result, although a prison sentence was imposed, the client avoided detention in court and received a suspended sentence. The client was able to avoid the risk of actual imprisonment, maintain social life, and return to daily life.

Prostitution brokerage is an offense with a very high risk of imprisonment when the actual business operation structure and profit scale are confirmed. In particular, where advertising conduct and a profit distribution structure are revealed, courts often assess the matter strictly.

This case is an example of Taelim accurately analyzing the characteristics of the case and responding by systematically organizing sentencing factors and persuading the court, rather than pursuing an unreasonable denial strategy. Taelim focused on reducing the risk of imprisonment by comprehensively presenting the client’s remorse, risk of reoffending, social relationships, and post-offense circumstances, going beyond a simple request for leniency, and achieved the result of a suspended sentence.
